What Is the Process of Marriage Annulment in Singapore?
[1] Claims for the Grounds for Annulment
To file for annulment of marriage, you must first submit a writ for annulment of your marriage along with the following documents:
- Statement of Claim – An outline of the grounds for annulment
- Statement of Particulars – Facts to support your claim
- Agreed Parenting Plan – The proposed arrangement for your kids in marriage after annulment if a mutual agreement can be reached
- Proposed Parenting Plan – The proposed arrangement for your kids in marriage after annulment if a mutual agreement cannot be reached
- Matrimonial Property Plan – If you and your spouse own a HDB flat, this document details your proposed arrangement post-annulment. (If the minimum occupation period is not met, surrendering the flat may be required)
[2] Interim Judgement from the Court
If the annulment is uncontested, the Court will grant Interim Judgement to prove that the marriage is void or voidable. However, if contested, the Court will conduct a hearing to assess the evidence presented and determine whether the grounds for annulment are met, thus establishing the marriage as void or voidable.
[3] Settlement of Ancillary Matters
After granting the Interim Judgement, the Court will proceed to settle the ancillary matters. This includes matters on child custody, division of matrimonial assets, and child/spousal maintenance or alimony.
[4] Final Judgement of Nullity
Once all the issues have been settled, the Court will grant the final Judgement of Nullity, declaring the marriage null and void. Thus, the marital status of both parties returns to “single.”
